Sierra Internet Services, Corp. Acceptable Use Policy (“AUP” or “POLICY”) 1. Introduction This Acceptable Use Policy applies to all users and customers of SIERRA INTERNET SERVICES, CORP. This POLICY provides a general understanding of SIERRA INTERNET SERVICES, CORP.’s Acceptable Use of the SIERRA INTERNET SERVICES, CORP. systems, services, and resources. It is designed to help protect our service, our customers, and the Internet community from irresponsible or illegal activities. If an SIERRA INTERNET SERVICES, CORP. account is used to violate this POLICY or is used for illegal purposes, SIERRA INTERNET SERVICES, CORP. reserves the right to terminate SERVICE without notice. 2. Prohibited Uses of SIERRA INTERNET SERVICES, CORP. Systems, Products, and Services (a) Use of SIERRA INTERNET SERVICES, CORP. account without authorization of the account holder. (b) Simultaneous connection with the same username and password. (c) Use of bots, programs, or scripts in an attempt to simulate activity, where the user is not physically attending the computer (“UNATTENDED ACCESS”). (d) Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This including, but not limited to, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. (e) Sending unsolicited mail messages, including the sending of “junk mail” or other advertising material to individuals who did not specifically request such material (“SPAM”). This includes, but not limited to, bulk mailing of commercial advertising, informational announcements, and political tracts. It also includes posting to the same or similar message to one or more newsgroups (excessive cross-posting or multiple-posting). SIERRA INTERNET SERVICES, CORP. accounts, services, or products may not be used to collect replies to messages sent from another Internet Service Provider (“ISP”) where those messages violate this AUP or that of another provider. (f) Unauthorized use, or forging, of mail header information (“SPOOFING”). (g) Unauthorized attempts by a user to gain access to any account or computer resource not belonging to that user (“CRACKING”, “PORT SCANNING”). (h) Obtaining or attempting to obtain service by means or device with the intend to avoid payment. (i) Knowingly engaging in activities that will cause a denial-of-service ( “SYCHRONIZED NUMBER SEQUENCE ATTACKS”) to any SIERRA INTERNET SERVICES, CORP. customer or user whether on the SIERRA INTERNET SERVICES, CORP network or another provider’s network. (j) Making fraudulently offers of items, services or products (“SCAMMING”). (k) Knowingly sending through email or file transfer protocol Viruses, Trojan Horses, Worms, or any program designed to corrupt data, prevent access to a computer or server, or cause denial of service of a computer or server, to any SIERRA INTERNET SERVICES, CORP. customer or user whether on the SIERRA INTERNET SERVICES, CORP network or another provider’s network. (l) Registration of Internic domain names to SIERRA INTERNET SERVICES, CORP.’s domain name servers (“DNS”) by anyone other than SIERRA INTERNET SERVICE, CORP or without explicit permission, is strictly prohibited. Any Internic domain name using SIERRA INTERNET SERVICES, CORP’s DNS must have SIERRA INTERNET SERVICES (SUP29-ORG) as the “Technical Contact” for the domain. 3. System Abuse SIERRA INTERNET SERVICES, CORP. considers the above practices to constitute SYSTEM ABUSE. Therefore these practices are prohibited and may result in immediate termination of the offender’s account and/or access, without a refund, at SIERRA INTERNET SERVICES, CORP.’s discretion. Any company or individual engaging in the above practices agrees to pay SIERRA INTERNET SERVICES, CORP. for all expenses and time (at $100.00 per hour) spent in dealing with any issues pertaining to these practices (Minimum $200.00).
